Around 10 p.m. Wednesday night Larimer County Sheriff’s Office received a report of a suspected drunk driver in Berthoud. Ten minutes later, the driver and deputies exchanged gunfire at Second Street and Welch Avenue.

Residents reported on social media hearing around 6 shots fired. According to the 8th Judicial District Critical Incident Response Team, within that approximate 10-minute time frame, both the suspect, later identified as Erik Daniel Locker, 51, and the deputies fired guns at each other. No deputies were injured in the exchange.

Locker was taken to Medical Center of the Rockies where he was treated for non-life-threatening injuries.

Following his release from the hospital, Locker was booked at the Larimer County Jail on charges of  attempted first-degree murder, menacing aggravated assault with a gun, violation of bail bond conditions, driving under the influence with three or more prior and failure to report upon striking an unattended vehicle or property.

The 8th Judicial District Critical Incident Response Team (CIRT) was activated to investigate the incident. Loveland Police Department will be leading the investigation in conjunction with CIRT.

Locker is scheduled to have his first appearance in court Friday, Aug. 6 at the Larimer County Justice Center.
